1. Purpose
This Acceptable Use Policy ("AUP") governs your use of The Design Phase platform, operated by DDI - TheDesignPhase LLC, a Wyoming limited liability company. It supplements and forms part of the Terms of Service. By using the Platform, you agree to comply with this AUP.
This AUP applies to all customers, workspace members, and any individual who accesses the Platform. Violations may result in immediate suspension or permanent termination of your account without notice and without refund.
2. Prohibited Uses
You must not use the Platform for any purpose that is unlawful, harmful, or prohibited by these terms. The following are expressly prohibited:
Illegal activity: Using the Platform for any purpose that violates applicable federal, state, or local law; collecting or processing personal data in violation of applicable privacy law; using the Platform in connection with fraud, money laundering, or financial crime; violating any export control or sanctions regulations.
Platform abuse: Accessing or attempting to access another customer's account, data, or workspace without authorisation; using automated scripts, bots, or crawlers to interact with the Platform beyond normal use; scraping, harvesting, or extracting data from the Platform using automated tools; deliberately overloading or stress-testing the Platform infrastructure without prior written consent from DDI; exploiting bugs, vulnerabilities, or unintended behaviours — instead, report them to support@thedesignphase.app; attempting to bypass, circumvent, or defeat any rate limiting, authentication, or security controls.
Impersonation and misrepresentation: Creating accounts that impersonate another business, individual, or entity; misrepresenting your identity, business type, or location during registration or use; creating multiple accounts to circumvent subscription limits, suspensions, or pricing.
Intellectual property: Reverse engineering, decompiling, or attempting to extract source code from the Platform; white-labelling or reselling the Platform without prior written permission from DDI; removing or altering DDI - TheDesignPhase LLC branding, attribution, or proprietary notices; using DDI's name, logo, or trademarks without prior written consent.
Harmful content: Uploading or transmitting any content that is defamatory, obscene, harassing, threatening, or offensive; uploading content that infringes the intellectual property rights of any third party; transmitting malware, viruses, ransomware, or any other malicious code.
3. Content Standards
Any content you submit to the Platform — including business names, project names, custom messages, session notes, register entries, and uploaded documents — must not:
Violate any applicable law or regulation; infringe the intellectual property or privacy rights of any third party; be defamatory, obscene, harassing, threatening, or discriminatory; constitute spam or unsolicited advertising; or contain malware, viruses, or malicious code.
You are solely responsible for all content you upload to or create within the Platform. DDI - TheDesignPhase LLC does not review user-generated content and assumes no responsibility for it.
4. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify DDI immediately at support@thedesignphase.app if you become aware of any unauthorised access to or use of your account.
You must not share your account credentials with any third party. Each user must have their own individual account. Service or shared accounts are not permitted.
5. Enforcement
DDI - TheDesignPhase LLC reserves the right to investigate any suspected violation of this AUP. Upon finding a violation, DDI may, at its sole and absolute discretion, take any of the following actions:
Issue a written warning; temporarily suspend your account; permanently terminate your account without notice and without refund for serious, repeated, or egregious violations; disclose information to law enforcement or regulatory authorities as required by law or to protect the rights and safety of DDI and its users; pursue all available legal remedies, including injunctive relief and monetary damages.
DDI's failure to enforce this AUP in any instance does not constitute a waiver of the right to enforce it in the future. All enforcement decisions are final.
6. Reporting Violations
If you become aware of a violation of this AUP — including suspected security vulnerabilities, abuse, or unauthorised use of the Platform — please report it to support@thedesignphase.app. We take all reports seriously and will investigate promptly.
